Terms of Use - Bitnuk AG (“Bitnuk”)

By using this website (“Site”), registering for a Bitnuk Account (“Account”) or using any other Bitnuk Services, you ("you, your, or yourself") are agreeing to accept and comply with the terms and conditions of use stated below ("Terms of Use"). You should read the entire Terms of Use carefully before using this Site or any of the Bitnuk Services.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
Bitnuk operates under the regulatory supervision of ARIF Genf, a self-regulating body approved by the Swiss Financial Market Supervisory Authority (FINMA) for the supervision of the financial intermediaries referred to in article 2 para. 3 of the Swiss Federal Law on combating money laundering and terrorism financing in the financial sector (AMLA). As Bitnuk is not subject to direct FINMA supervision, regulatory issues should be addressed to ARIF.
Bitnuk is not a bank and, as such, is not part of a depositor protection scheme.
References to Bitnuk are also references to its owners, directors, investors, employees.
Bitnuk allows buyers ("Buyers") and sellers ("Sellers") to use its and its partners capabilities to buy and sell cryptocurrecies such as Bitcoins.
The Service operated by Bitnuk allows all customers of the Service ("Members") to:
- Buy and Sell Bitcoin, as available (herein “Bitcoin” or “cryptocurrency”).
- Transfer cryptocurrency and fiat currency to other Members and to non-members who must become Members prior to withdrawing such cryptocurrency or fiat money.
- Bitnuk intends to allow Members to Buy and Sell other cryptocurrencies including but not limited to Ethereum and other cryptocurrencies in the future.
Depending on your country of residence, you may not be able to use all the functions of the Site. It is your responsibility to follow the rules and regulations applicable in your country of residence and/or country from which you access this Site and Services. As long as you agree to and comply with these Terms of Use, Bitnuk grants you the personal, non-exclusive, non-transferable, non-sublicensable, and limited right to enter and use the Site and the Service.

By registering for an Account, you expressly represent and warrant:
- That you have accepted these Terms of Use; and
- That you are at least 18 years of age and have the full capacity to accept these Terms of Use and enter into a transaction involving cryptocurrencies.
- That you accept to become customer of Swiss Wealth Management AG, company registered with the Swiss Companies Register under the company number CHE-105.854.576 with its registered address at Metallstrasse 8, 6300 Zug, Switzerland and affiliated with d’Organisme de Surveillance pour Intermédiaires Financiers & Trustees (“SO-FIT”) (affiliation No.: 1179) (hereinafter - SWM) and to be bound by SWM terms of use, for provision of supplementary services required for functioning of Bitnuk AG products and services. Becoming customer of SWM is subject to SWM terms of use and KYC/AML requirements. Becoming customer of Bitnuk AG shall not automatically render the affiliation with SWM and SWM may at any time independently decide to offboard you or restrict any part of the service. Risk Warning
The trading of goods and products, real or virtual, as well as virtual currencies involves a significant risk. Prices can and do fluctuate on any given day. Such price fluctuations may increase or decrease the value of your assets at any given moment. Any currency, virtual or not, may be subject to large swings in value and may even become worthless. There is an inherent risk that losses will occur as a result of buying, selling, or trading anything on a market.
Trading cryptocurrencies also has special risks not generally shared with official currencies, goods, or commodities in a market. Unlike most currencies that are backed by governments, other legal entities, or commodities such as gold or silver, cryptocurrencies are a unique type of Internet digital currency, backed by technology and trust. There is no central bank that can issue more currency or take corrective measures to protect the value of cryptocurrencies in a crisis.
Instead, cryptocurrecies are an as-yet autonomous and largely unregulated global system of firms and individuals. Traders put their trust in a digital, decentralised, and partially anonymous system that relies on peer-to-peer networking and cryptography to maintain its integrity.
The trading of cryptocurrecies is often susceptible to irrational bubbles or loss of confidence, which could collapse demand relative to supply. For example, confidence might collapse in cryptocurrecies because of unexpected changes imposed by software developers or others, a government crackdown, the creation of superior competing alternative currencies, or a deflationary or inflationary spiral. Confidence might also collapse because of technical problems: if the anonymity of the system is compromised, if money is lost or stolen, or if hackers or governments are able to prevent any transactions from settling.
There may be additional risks that we have not foreseen or identified in these Terms of Use. You should carefully assess whether your financial situation and tolerance for risk are suitable for buying, selling, or trading cryptocurrecies.
We use our banking providers in order to receive client funds and make payments. Our banking providers DO NOT transfer, exchange, or provide any services in connection with cryptocurrecies.
Limited Right of Use
Unless otherwise specified, all Materials on this Site are the property of Bitnuk and are protected by copyright, trademark, and other applicable laws. You may view, print, and/or download a copy of the Materials from this Site on any single computer solely for your personal, informational, and/or non-commercial use, provided you comply with all copyright and other proprietary notices.
The trademarks, service marks, and logos of Bitnuk and others used in this Site ("Trademarks") are the property of Bitnuk and their respective owners. The software, text, images, graphics, data, prices, trades, charts, graphs, video, and audio used on this Site belongs to Bitnuk. The Trademarks and Materials should not be copied, reproduced, modified, republished, uploaded, posted, transmitted, scraped, collected, or distributed in any form or by any means, whether manual or automated. The use of any such Materials on any other Site or networked computer environment for any other purpose is strictly prohibited; any such unauthorised use may violate copyright, trademark, and other applicable laws, and could result in criminal or civil penalties.
Maintaining Your Account: Bitnuk’s Rules
This Site is for your personal and non-commercial use only. We are vigilant in maintaining the security of our Site and Service. By registering with us, you agree to provide Bitnuk with current, accurate, and complete information about yourself, as prompted by the registration process, and to keep such information updated. Failure to do so constitutes a breach of these Terms of Use, which may result in immediate termination of your account on our Service. You further agree that you will not use any Account other than your own, access the Account of any other Member at any time, or assist others in gaining unauthorised access.
The creation or use of Accounts without obtaining prior express permission from Bitnuk will result in the immediate suspension of all said Accounts, as well as all pending purchase/sale offers. Any attempt to do so or to assist others (Members or otherwise), or the distribution of instructions, software, or tools for that purpose, will result in the Accounts of such Members being terminated. Termination is not the exclusive remedy for such a violation, and Bitnuk may elect to take further action against you.
You are also responsible for maintaining the confidentiality of your Account information, including your password, and safeguarding your account and all activity including Transactions that are posted to your Account. Cryptocurrency transactions are irreversible once sent, so be sure to carefully confirm the receiving address before initiating a Bitcoin transaction. Any actions on the Site, transactions, orders and operations initiated from your Account or using your password (1) will be considered to have been made by you, and (2) is irrevocable once validated using your password or made through your Account. If there is suspicious activity related to your Account, we may, but are not obligated to, request additional information from you, including authenticating documents, and freeze any transactions pending our review. You are obligated to comply with these security requests or accept the termination of your Account. You are required to notify Bitnuk immediately of any unauthorised use of your Account or password, or any other breach of security, by email to [email protected]. The account of any Member who violates these rules may be terminated and the Member held liable for losses incurred by Bitnuk or any user of the Site.
Lastly, you agree that you will not use the Service to perform criminal activity of any sort, including but not limited to money laundering, illegal gambling operations, terrorist financing, malicious hacking or any criminal or illegal activity.
The minimum allowable buy or sell is EUR 5.

VERIFICATION OF ACCOUNTS
The creation and use of your Account is subject to verifications, as required by statutory and regulatory obligations incumbent on Bitnuk. You agree to provide us with the information we request for the purposes of identity verification, compliance with know-your-customer rules, as well as detection of money laundering, terrorism financing, fraud or any other financial crime. The requested information may include Personal Data (please refer to our Privacy Policy). By providing us with the information we request, you confirm that it is true and accurate, and agree to inform us in case of change concerning such information. Your Account will be blocked until we will satisfied with the information you have provided and determine in our sole discretion that it is sufficient to validate your Account. In the meantime, you will not be allowed to terminate your Account or request the deletion of the Personal Data processed in the course of verification operations. Bitnuk utilises and thus shares information with a third-party AML verification tool in addition to its internal identification screening procedures.
Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms of Use.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.
Availability of Services
All services are provided without warranty of any kind, either express or implied, and in particular without implied warranties of merchantability and fitness for a particular purpose. We do not guarantee that this Site will be available 100% of the time to meet your needs. We will strive to provide you with the Service as soon as possible, but there are no guarantees that access will not be interrupted or that there will be no delays, failures, errors, omissions, or loss of transmitted information.
We will use reasonable endeavours to ensure that the Site can be accessed by you in accordance with these Terms of Use. However, we may suspend the use of the Site for maintenance and will make reasonable efforts to give you notice of this. You acknowledge that this may not be possible in an emergency, and accept the risks associated with the fact that you may not always be able to use the Site or carry out urgent transactions using your Account.
APIs and Widgets
We may provide certain parties with access to specific data and information through our API (Application Programming Interface) or widgets. We also may provide widgets for your use to enter our data on your Site. You are free to use these in their original unmodified and un-altered state.
External Websites
Bitnuk makes no representations whatsoever about any external or third-party website you may access through the Site. Occasionally, the Bitnuk website may provide references or links to other websites ("External Websites"). We do not control these External Websites or third-party sites or any of the content contained therein. You agree that we are in no way responsible or liable for the External Websites referenced or linked from the Bitnuk website, including but not limited to website content, policies, failures, promotions, products, opinions, advice, statements, prices, activities and advertisements, services, or actions, and/or any damages, losses, failures, or problems caused by, related to, or arising from those sites. You shall bear all risks associated with the use of such content.
External Websites have separate and independent terms of use and related policies. We request that you review the policies, rules, terms, and regulations of each site that you visit. It is up to you to take precautions to ensure that whatever you select for your use is free of items such as viruses, worms, Trojan horses, and other items of destructive nature.
Financial Advice
Bitnuk does NOT provide any investment advice in connection with the Services described in these Terms of Use. We may provide information on the price, range, and volatility of cryptocurrecies that are available on our platform and events that have affected the price of such cryptocurrecies, but this must not be considered investment advice nor should it be construed as such. Any decision to purchase or sell cryptocurrecies is solely your decision and we shall not be liable for any loss suffered.
Financial Regulation
Bitnuk is an authorized member firm of Association Romande des Intermédiaires Financiers ("ARIF").
Wallet services
Bitnuk has developed and offers a wallet solution in which you can store cryptocurrencies in self-custody ("Crypto vault"). Crypto vault is a non-custodial wallet, which is locally generated on your device an remain inaccessible by Bitnuk or any 3rd party. Your private keys are created and stored locally on your device and Bitnuk does not have access to the private key stored on your device at any time and therefore you are responsible for securing the private key. You understand and acknowledge that without the Private Key you have no control over your cryptocurrency and may suffer a permanent loss of access to the cryptocurrency held in your Crypto vault.
Should you desire to sell your cryptocurrencies, you are required to initiate a transfer from your controlled Crypto vault to Bitnuk trading desk via available user interface. Your transfer will be complete only if you will pass Bitnuk AML controls. In the event of failure to pass AML controls or execute the sale transaction within 10 (ten) days, the transfer will be rejected and funds will be returned to you. Repeated attempts to transfer funds after unsuccessful (negative) outcome of AML checks, and/or failure to execute transaction within 10 (ten) days may result in temporary or permanent suspension of the service to you.
Data protection
Privacy is very important to us. Full details of our Privacy Policy can be found on our Privacy Policy page. We recommend that you read the Privacy Policy carefully, so that you know the data that we collect, how we use the data and who we share your data with.
Disclosures to Legal Authorities and Authorized Financial Institutions
We may share your Personal Data with law enforcement, data protection authorities, government officials, and other authorities when:
- Required by law;
- Compelled by subpoena, court order, or other legal procedure;
- We believe that disclosure is necessary to prevent damage or financial loss;
- Disclosure is necessary to report suspected illegal activity; or
- Disclosure is necessary to investigate violations of our Terms of Use or Privacy Policy.

Unclaimed Property
If we hold cash or crytocurrency, and we are unable to contact you and have no record of your use of the Bitnuk Services for several years, applicable law may require us to report the cash or crytocurrency as unclaimed property to the authorities in certain jurisdictions. We will try to locate you at the address shown in our records, but if we are unable to, we may be required to deliver any such cash or crytocurrency to the authorities in certain jurisdictions as unclaimed property. We reserve the right to deduct a dormancy fee or other administrative charges from such unclaimed funds, as permitted by applicable law.
Jurisdiction/Governing Law
The Terms of Use shall be governed and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions. The parties hereto agree to irrevocably submit to the exclusive jurisdiction of the courts of Switzerland.
Our failure to enforce any right or provision of these Terms of Use will not be considered a waiver of those rights. If any provision of these Terms of Use is held to be invalid or unenforceable by a court, the remaining provisions of these Terms of Use will remain in effect. These Terms of Use constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
Limitation of Liability
To the extent permitted by law, Bitnuk will not be held liable for any damages, loss of profit, loss of revenue, loss of business, loss of opportunity, loss of data, indirect, or consequential loss, unless the loss suffered arose from negligence or wilful deceit or fraud. Nothing in these Terms of Use excludes or limits the liability of either party for fraud, death, or personal injury caused by its negligence, breach of terms implied by operation of law, or any other liability which may not be limited or excluded by law. Although Bitnuk endeavours to provide accurate and timely information on the Site, the Site may not always be entirely accurate, complete or current and may include errors. We may change or update the Site at any time without notice, and you should accordingly verify with independent sources all information before relying on it to take decisions or actions. You remain entirely responsible for your decisions and actions.
Subject to the foregoing, Bitnuk’s aggregate liability for claims based on events arising from or in connection with any single Member's use of the Site and/or Service, whether in contract or tort (including negligence) or otherwise, shall in no circumstances exceed the greater of either (a) the total amount held on Account for the Member making a claim less any amount of Commission that may be due and payable in respect of such Account; or (b) 100% of the amount of the Transaction(s) that are the subject of the claim less any amount of Commission that may be due and payable in respect of such Transaction(s).
Legal Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
Bitnuk its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.
Indemnity
To the full extent permitted by applicable law, you hereby agree to indemnify Bitnuk and its partners against any action, liability, cost, claim, loss, damage, proceeding, or expense suffered or incurred if directly or indirectly arising from your use of Bitnuk's Sites, your use of the Service, or your violation of these Terms of Use.
Miscellaneous
If we are unable to perform the Services outlined in the Terms of Use due to factors beyond our control including but not limited to an event of force majeure, change of law, or change in sanctions policy, we shall not be liable for the Services provided under this agreement during the time period coincident with the event.
Modification of Terms
Bitnuk reserves the right to change, add, or remove parts of these Terms of Use at any time and at its sole discretion. You will be notified of any changes in advance through your Account. Upon such notification, it is your responsibility to review the amended Terms of Use. Your continued use of the Site following the posting of a notice of changes to the Terms of Use signifies that you accept and agree to the changes, and that all subsequent transactions by you will be subject to the amended Terms of Use.
Definitions
Account. The contractual arrangement wherein a Bitnuk Member has accepted our Terms of Use and Privacy Policy, and received approval to use Bitnuk Services, including the purchase and sale of cryptocurrecies, and to perform associated Transactions.
Bitcoins. The Peer-to-Peer Internet digital currency further described at Bitcoin.org.
Cryptocurrecies. All digital currencies, including but not limited to Bitcoin.
Buyer(s). Member(s) that are submitting an offer to buy cryptocurrency through the Service.
Commission or Fee. Refers to the fee which is payable to Bitnuk on each Transaction, such as a buy or sell of cryptocurrency. You can review our Fees on our Fees page.
Member(s). Refers to Buyers and Sellers as well as any holder of an Account.
Personal Data. Information that identifies an individual, such as name, address, e-mail address, trading information, and banking details. “Personal Data” does not include anonymised and/or aggregated data that does not identify a specific user.
Price. The "price per coin" for which Members are willing to purchase or sell cryptocurrecies, using the Service in a purchase or sell transaction. The Price may be expressed in any of the currencies deposited by Members in their Account and supported by the Service. See our Site for a full list of currencies.
Bitnuk may not offer currencies other than Euros at this time.
Seller(s). Member(s) that submit an offer to sell cryptocurrecies through the Service.
Service(s). The technological platform, functional rules, and market managed by Bitnuk. to permit Sellers and Buyers to purchase and sell cryptocurrecies.
Transaction. Includes the following:
- The action between the Member to Buy and/or Sell cryptocurrencies through the Service for currencies at the then-current market rate.
- The transfer of cryptocurrencies between Members ("Transfer Transaction");
- The transfer of cryptocurrecies among Members ("Transfer Transaction");
- The transfer of currencies among Members ("Currency Transfer Transaction"); and
- Bitnuk may not offer all these transaction types at this time.

Transaction Price. The total price paid by the Buyer for each Transaction performed through the Service.
Consent to Use of Cookies

Changes
We reserve the right, at our sole discretion, to modify or replace these Terms of Use at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
Unencrypted email messages sent over the Internet are not secure and Bitnuk is not responsible for any damages incurred as a result of sending email messages in this way. We suggest existing Members always log in to the Bitnuk site and use the internal support messaging system by clicking “Support” in the footer menu or, for non Members, always send email in encrypted formats. You are welcome to send PGP encrypted emails to us. The instructions and keys to do so are available upon request. Please never send us or anyone else your password by email.
If you send unencrypted or unsecured email or other types of communications to us, we may respond using the same channels and you hereby accept the risks associated therewith.
Bitnuk will never contact you from an email account that does not end with @bitnuk.com. If anyone, including a person that you know to be associated with Bitnuk ever contacts you via email with an address that does not end with @bitnuk.com, please notify our compliance department at [email protected] immediately.

This notice shows our commitment to protect your privacy rights and sets out the basis on which any personal information we collect from you, or that you provide to us, will be processed by us. It applies to:
- the website/portal features and services provided to you when you visit our websites, portals or our payment panels our clients may use on their websites;

INFORMATION WE MAY COLLECT FROM YOU
You may provide some information to us, for example when you enquire for or make an application for the Bitnuk Services, register to use and/or use any Bitnuk Services, by filling in forms on one of our websites, participating in one of our events or by corresponding with by us phone, e-mail, web chat or otherwise. We may also obtain data about you from third parties, like credit reference and fraud prevention agencies.
USES OF THE INFORMATION
We use information we collect about you to provide you with the products we offer, to notify you about changes to our products and to improve our products. If you use one of our financial products, we will also use your information to assess your financial situation and to try to identify and prosecute possible frauds.

We may share your personal information with third parties to provide you with the products we offer, including service providers, credit reference agencies and financial institutions. WHERE WE STORE YOUR PERSONAL DATA AND DATA SECURITY
The information Bitnuk collects from you may be transferred to, stored at and processed by recipients located in destinations outside the European Economic Area ("EEA"). These countries may have data protection standards that are different to (and, in some cases, lower than) those in which you reside. We will take all steps necessary to ensure that the recipients will use and protect your information in the same secure way that we do.
If we have given you (or if you have chosen) a password, access code or any other secure means or access or authentication which enables you to access certain parts of our site, you are responsible for keeping this password confidential and complying with our instructions. You must not share your password or other login credentials with anyone, and you hereby authorise Bitnuk to act upon instructions and information from any person that enters your credentials.
The transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our site, unless you are communicating with us through a secure channel provided by us. Once we have received your information, we will use strict procedures and security features in an effort to prevent unauthorised access.
YOUR RIGHTS
Where applicable, you may have certain rights under data protection legislation, including the right to access, correct, update or delete your personal information; object to or restrict its processing; request to transfer certain of your personal information to another service provider (so called, data portability); or to revoke any consent you have given.

AUTOMATED DECISION MAKING
Automated decisions mean that a decision concerning you is made automatically on the basis of a computer determination (using software algorithms), without our human review.
For example, we use automated decisions to complete a credit assessment on you when you apply to financial services of Bitnuk, or to carry out anti-fraud checks on the transactions you perform. However, if you are in the European Union or Switzerland, you have the right to object the automated decision and have it manually reviewed based also on information that you can provide.

LEGAL BASIS FOR PROCESSING
Bitnuk will process your personal information only when we have one of the following grounds:
- On the basis of your consent, for example to send you marketing messages;
- Where necessary to enter into a contract with you and perform our obligations under that contract;
- Where we have a legitimate interest, subject to such processing not overriding your own rights and freedoms;
- Where we have a legal obligation to collect your personal information or otherwise needs your Personal Information to protect your vital interests or those of another person; or
- Exceptionally, when necessary in the public interest, for example when law enforcement agencies request information to investigate a crime.

This Privacy Notice, together with our Terms of Use, governs Bitnuk’s collection, processing and use of your Personal Data. As used in this Privacy Policy, "Bitnuk", "we", "us" or "our" refers to Bitnuk AG, a Swiss Asset Management and E-Money Institution.
References to “you” or “your” in this privacy notice are to the individual who is accessing or applying to use the Bitnuk Services (as defined below) either on your own account or on behalf of a business. This includes, in relation to a customer or prospective customer of Bitnuk, any sole trader and any principals, including the managing and financial directors, any other directors and officers, shareholders, partners and beneficial owners of a customer, as well as any member of staff accessing or using the Bitnuk Services on behalf of a customer.
This notice shows our commitment to protect your privacy rights and sets out the basis on which any personal information we collect from you, or that you provide to us, will be processed by us. It applies to:
- the website/portal features and services provided to you when you visit Bitnuk’s website
- your use of software including terminals, mobile and desktop applications provided by Bitnuk; and
- email, other electronic messages including SMS, telephone, web chat, website/portal and other communications between you and Bitnuk.
Together these are all referred to in this notice as “Bitnuk Services”.
Please read the following carefully to understand our views and practices regarding your Personal Data and how we will treat it.
Bitnuk is the data controller under this Privacy Policy, which sets out the manner in which Bitnuk, as data controller, may use your Personal Data.
“DPL” herein means data protection law applicable to Bitnuk, including the Swiss Federal Act on Data Protection (CC 235.1 Federal Act of 19 June 1992 on Data Protection (FADP)) and the EU General Data Protection Regulation 2016/679, their successors or implementing texts. Personal Data" has the meaning set forth in DPL. This notice covers our use of your Personal Data arising from use of the Bitnuk website (www.bitnuk.com) as well as registering / subscribing / buying / selling / using our products and services. In this Privacy Policy capitalised terms have the meaning set out in the Definitions section below.
Bitnuk is committed to protecting and respecting your privacy. The purpose of this Privacy Policy is to describe:
- The types of Personal Data we collect and how it may be used;
- Our use of cookies and similar technology;
- How and why we may disclose your Personal Data to third parties;
- The transfer of your Personal Data within and outside of Switzerland and the European Economic Area (“EEA”);
- Your statutory rights concerning your Personal Data;
- The security measures we use to protect and prevent the loss, misuse, or alteration of Personal Data; and
- Bitnuk’s retention of your Personal Data.
Collection and use of personal information
A. Personal Information We Collect
We collect Personal Data to provide you with our Services. When we require certain personal information from users it is because we are required by law to collect this information or it is relevant for specified purposes. Any information you provide to us that is not required is voluntary. You are free to choose whether to provide us with the types of personal information requested, but we may not be able to serve you as effectively or offer you all of our Services when you do choose not to share certain information with us.
For example, we collect personal information which is required under the law to register for an account, add a payment method, or execute a transaction. We also collect personal information when you use or request information about our Services, subscribe to marketing communications, request support, complete surveys or sign up for a Bitnuk event. We may also collect personal information from you offline, such as when you attend one of our events, or when you contact customer support. We may use this information in combination with other information we collect about you as set forth in this Privacy Policy. This may include:
- Personal Identification Information: Full name, date of birth, age, nationality, gender, signature, utility bills, photographs, phone number, home address, and/or email.
- Account information, such as username, password, account settings and preferences;
- Financial information, such as bank account numbers, bank statement, and trading information;
- Formal Identification Information used for identity verification: Tax ID number, passport number, driver’s license details, national identity card details, photograph identification cards, and/or visa information.
- Residence verification information, such as utility bill details or similar information;
- Information regarding the way in which you use our services, such as when you used our services and the specific services used; and
- Information relating to communications with us, whether through the Bitnuk website or via e-mail, over the phone or via any other medium.
- Employment Information: Office location, job title, and/or description of role.
- Transaction Information: Information about the transactions you make on our Services, such as the name of the recipient, your name, the amount, and/or timestamp.
- Online Identifiers: Geo location/tracking details, browser fingerprint, OS, browser name and version, and/or personal IP addresses.
- Usage Data: Survey responses, information provided to our support team, public social networking posts, authentication data, security questions, user ID, click-stream data and other data collected via cookies and similar technologies. Please read our Cookie Statement for more information.
- Any other information that you or your customer provide to us.
We also automatically collect certain computer, device and browsing information when you access the Bitnuk website or use Bitnuk Services. This information is aggregated to provide statistical data about our users' browsing actions and patterns, and does not personally identify individuals. This information may include:
- Computer or mobile device information, including IP address, operating system, network system, browser type and settings. This information may be directly obtained by Bitnuk or through third party services such as Google Analytics and other tracking tools. This service usage data helps us our systems to ensure that our interface is accessible for users across all platforms and can aid during criminal investigations;
- Website usage information.
We also collect information through our applications. if you download or use mobile or desk top applications provided by Bitnuk, we may receive information about your location and your device or the service you are using (including where a payment transaction takes place). Some devices allow applications to access real-time location-based information (for example GPS). Our mobile and desktop apps may collect such information from your mobile device or your computer at any time while you download or use our apps, if your device has real-time location data access enabled. Where required, we will always seek to notify you if it is our intent to collect real-time location information and, also where required by law, obtain your consent. We may use such information for regulatory purposes, our own due diligence checks, to better understand transaction patterns and to optimise your experience.
We may receive information about you from other sources and add it to our account information. For example, we work closely with, and receive information from, third parties like business partners, financial institutions, merchants, subcontractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers, credit reference and fraud prevention agencies. Credit reference and fraud prevention agency use is further explained below. We may also review public comments and opinions made on social networking sites (e.g. Facebook and Twitter) to better understand our customers and our provision and development of the Bitnuk Services.
Finally, we may collect Personal Data from third party partners and public sources, which include:
- Reputational information;
- Financial information;
- Business activities of corporate customers.
We need to collect certain types of information for compliance with legal requirements relating to our anti-fraud/anti-money laundering/counter financing of terrorism/know your customer obligations. If this information is not provided we will not be able to provide a service for you. Your Personal Data may also be processed if it is necessary on reasonable request by a law enforcement or regulatory authority, body or agency or in the defense of legal claims. We will not delete Personal Data if relevant to an investigation or a dispute. It will continue to be stored until those issues are fully resolved. We may perform behavioral tracking of a customer's activities on our Bitnuk website or across different websites, or allow third-party data collection through our Bitnuk Service.
It is important to note that the Personal Data we collect on you when you create an account will be retained for the mandatory retention period set forth by applicable law and as necessary for us to maintain an exhaustive documentation of our operations as required from us as regulated financial sector professionals, even if your account has not been successfully activated (e.g., if account verification has not been completed) or no transaction has been made using it.
Our privacy notice has incorporated elements from the General Data Protection Regulation (GDPR) as we act in accordance to its personal information processing rules within the European Economic Area (EEA). For individuals who reside in the European Economic Area (including the United Kingdom) or Switzerland (collectively “EEA Residents”), pursuant to Article 6 of the EU General Data Protection Regulation (GDPR) or any equivalent legislation (collectively “EEA Data Protection Law”), we process this personal information to comply with our legal obligations.
B. Use of Cookies and Similar Technology
Bitnuk receives and stores certain information automatically whenever you interact with Bitnuk. The Bitnuk website uses cookies. Cookies are small text files that are placed on your computer by websites that you visit, including Bitnuk. They are widely used in order to make websites work, or work more efficiently, as well as to provide information to the owners of the site.
Cookies are typically stored on your computer's hard drive. Information collected from cookies is used by us to evaluate the effectiveness of our website, analyze trends, and administer the Platform. The information collected from cookies allows us to determine such things as which parts of our website are most visited and difficulties our visitors may experience in accessing our website. With this knowledge, we can improve the quality of your experience on the Platform by recognizing and delivering more of the most desired features and information, as well as by resolving access difficulties. We also use cookies and/or a technology known as web bugs or clear gifs, which are typically stored in emails to help us confirm your receipt of, and response to, our emails and to provide you with a more personalized experience when using our website. The information we collect includes:
- Technical information, including the Internet protocol (IP) address used to connect your computer or device to the Internet, your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system platform;
- Information about your visit or whether you opened an email, including the full Uniform Resource Locators (URL) clickstream to, through and from our site (including date and time); products or services you viewed or searched for; page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks and mouse-overs) and methods used to browse away from the site page and any phone number used to call our customer service number.
We use third party service provider(s), to assist us in better understanding the use of our website. Our service provider(s) will place cookies on the hard drive of your computer and will receive information that we select that will educate us on such things as how visitors navigate around our site, what products are browsed, and general Transaction information. Our service provider(s) analyses this information and provides us with aggregate reports. The information and analysis provided by our service provider(s) will be used to assist us in better understanding our visitors' interests in our website and how to better serve those interests. The information collected by our service provider(s) may be linked to and combined with information that we collect about you while you are using the Platform. Our service provider(s) is/are contractually restricted from using information they receive from our website other than to assist us.

However, disabling cookies might make it impossible for you to use certain features or our website or services, such as logging on to your Bitnuk Account or making transactions. Your use of our website or service with a browser that is configure to accept cookies constitutes an acceptance of our and third-party cookies.

C. How We Use Your Personal Information
We collect and use your information for a variety of reasons. We need some information to enter into and perform our contract – for example your contact and payment details. Some information processing is required by law due to our anti-fraud screening obligations or in the public interest such as making sure we verify our customers' identities.
Some information is processed because you've given your consent to that, which can be withdrawn in your account preferences and settings. Other information we collect and use because we have legitimate business interests to so, having taken into account your rights, interests and freedoms.
We may use your Personal Information to:
- Create and administer your Bitnuk account and generally for accounting, billing, maintenance of legal documentation and claim and dispute management. Related processing operations are necessary for the performance of a contract with you (or to take steps at your request prior to entering into a contract), and for compliance with legal obligations to which we are subject;
- Process your Bitnuk transactions. Related processing operations are necessary for the performance of a contract with you and for compliance with legal obligations to which we are subject;
- Verify your identity in accordance with applicable know-your-customer, money laundering and other financial sector legislation or regulations, including as required for compliance with the Bitnuk Anti Money Laundering ("AML")/Counter Terrorist Financing ("CTF") Policy, as well as address other law enforcement needs as more fully described in our Terms of Use, and generally as required for compliance with legislation and regulations applicable to Bitnuk. Bitnuk utilises and thus shares information with a third-party AML verification tool in addition to its internal identification screening procedures.
- Personalise your Bitnuk Services experience. Related processing operations are necessary for purposes of our legitimate interests (that is, improving our services);
- Analyse Bitnuk website usage, and improve our website and website offerings. Related processing operations are necessary for purposes of our legitimate interests (that is, improving and promoting our services);
- Help us respond to your customer service requests and support needs. Related processing operations are necessary for the performance of a contract with you, and for purposes of our legitimate interests (that is, improving our services and offering you the best experience);
- Contact you about Bitnuk Services. The email address you provide may be used to communicate information and updates related to your use of the Bitnuk Services.
Automated Decisions Making
Automated decisions mean that a decision concerning you is made automatically on the basis of a computer determination (using software algorithms), without our human review. We may make automated decisions on certain matters. For example, we may do this to decide whether we can provide our services to you based on a credit check/risk profiling. Depending on the outcome of the credit check/risk profiling, a decision will be reached automatically as to whether we are able to provide products or services to you based on your credit worthiness.

D. Marketing
We may also occasionally communicate company news, updates, promotions and related information relating to similar products and services provided by Bitnuk. We may also administer a contest, promotion, survey or other site features as will be more explained on the website. We shall only do this where you have given us your consent or otherwise where we are permitted to do so under the DPL in pursuit of our legitimate interests (that is, promoting our services).
We may share Personal Data with third parties to help us with our marketing and promotional projects, or sending marketing communications.
If you want to opt out of receiving promotional and marketing emails, text messages, post and other forms of communications from us [or our promotional partners] in relation to which you might receive in accordance with this section, you can best opt out by using one of the following ways:
- Log into your account and update your profile.
- Click "unsubscribe" at the bottom of an email we sent you.

If you do opt out of receiving promotional and marketing messages, we can still contact you regarding our business relationship with you, such as account status and activity updates, survey requests in respect of products and services we have provided to you after you reserve from us, reservation confirmations or respond to your inquiries or complaints, and similar communications.
DISCLOSING AND TRANSFERRING PERSONAL DATA
We may disclose your Personal Data to third parties and legal and regulatory authorities, and transfer your Personal Data outside the Switzlerland and the EEA, as described below.
A. Disclosures to Third Parties
There are certain circumstances where we may transfer your Personal Data to employees, contractors and to other parties.
- We may share information about you with other members of our group of companies so we can provide the best service across our group. They are bound to keep your information in accordance with this Privacy Policy;
- We may also share your information with certain contractors or service providers. They may process your Personal Data for us, for example, if we use a marketing agency. Other recipients/service providers include advertising agencies, IT specialists, database providers, backup and disaster recovery specialists, email providers or outsourced call centres. Our suppliers and service providers will be required to meet our standards on processing information and security. The information we provide them, including your information, will only be provided in connection with the performance of their function;
- We may also share your information with certain other third parties. We will do this either when we receive your consent or because we need them to see your information to provide products or services to you. These include credit reference agencies, anti-fraud databases, screening agencies and other partners we do business with.
- We may share your information to improve and develop our business, including without limitation to optimise our websites/portals, products and services. This may include using information you insert into forms but do not submit to us, for example by using that information to optimise our website(s) and contacting you for customer services purposes in relation to that form. We can also use your personal information to develop and test new products and services.
Your Personal Data may be transferred to other third party organisations in certain scenarios:
- If we're discussing selling or transferring part or all of our business – the information may be transferred to prospective purchasers under suitable terms as to confidentiality;
- If we are reorganised or sold, information may be transferred to a buyer who can continue to provide services to you;
- If we're required to by law, or under any regulatory code or practice we follow, or if we are asked by any public or regulatory authority – for example the Police;
- If we are defending a legal claim your information may be transferred as required in connection with defending such claim.
- To comply with local and national laws;
- To send marketing messages, to provide you with the information on products and services you have requested or we think may be of interest to you; to obtain your views on our goods, services and our website(s); in respect of marketing, market research and similar activities, we may use your personal information for such purposes whether or not you are accepted as or continue to receive Bitnuk Services. If you no longer wish to receive marketing or promotional information from Bitnuk, you can always stop it;
- to manage and mitigate our credit risks. if you apply for one of our financial products we will assess your financial position (and / or of your business), to the extent this is provided for in the applicable Terms of Use. This credit check will also affect any linked parties such as directors, shareholders and principals. We can do so by receiving and sharing information from and with credit reference agencies and fraud prevention agencies. This credit check will affect also anyone with whom you have a joint account or similar financial association. If it is a joint application, and such link does not already exist, then one may be created. These links will remain until you file a “notice of disassociation” at the credit reference agencies. For your information, the agencies will record our enquiries which may be seen by other companies who make their own credit enquiries; and a “footprint” may be placed on your credit file, whether or not you are accepted as our customer. If you are a director, we will seek confirmation from credit reference agencies that the residential address that you provide is the same as that held by the relevant companies’ registry (where applicable). In addition, where you take services from us, we will give information on how you manage your accounts to the credit reference agencies. If you do not repay any monies in full and on time, credit reference agencies will record the outstanding debt and may share this information with other organization that perform checks similar to ours. Records remain on file at such agencies for 6 years after they are closed, whether settled by you or defaulted. - To prevent, detect and prosecute fraud or crime, BItnuk may participate in anti-fraud initiatives, which involve assessing you (and/or your customers) and monitoring your transactions and/or locations, to detect patterns requiring investigations or otherwise profile and assess the likelihood of fraud occurring. We can do so utilizing products and services from third parties. Besides, if you give us false or inaccurate information about you, or we identify or suspect a fraud or a crime, we may pass your information to fraud prevention agencies and to law enforcement agencies, and we may decide to take legal action against you;
- To prevent or mitigate information security risk;
- To manage and enforce our rights, terms of use or any other contracts with you (and/or your business), including to manage any circumstances where transactions, rewards or points are disputed; manage, investigate and resolve complaints; or recover debt or in relation to your insolvency;
Your Personal Data may be shared if it is made anonymous and aggregated, as in such circumstances the information will cease to be Personal Data.
Your information will not be sold, exchanged, or shared with any third parties without your consent, except to provide Bitnuk Services or as required by law.
Bitnuk’s third party service providers are contractually bound to protect and use such information only for the purposes for which it was disclosed, except as otherwise required or permitted by law. We ensure that such third parties will be bound by terms complying with DPL.
B. Disclosures to Legal Authorities
Bitnuk may be required by law to pass information about you to regulatory authorities and law enforcement bodies worldwide, or we may otherwise determine that it is appropriate or necessary to do so. Such disclosures may also include requests from governmental or public authorities, or with commercial organizations with whom you may have had dealings and whom are seeking to mitigate fraud risk, or for the purposes of litigation or legal process, national security or where we deem it in the national or public interest or otherwise lawful to do so. As such, we may share your Personal Data with law enforcement, data protection authorities, government officials, and other authorities when:
- Compelled by court order, or other legal procedure.
- Disclosure is necessary to report suspected illegal activity.
- Disclosure is necessary to investigate violations of this Privacy Policy or our Terms of Use.
C. International Transfers of Personal Data
We store and process your Personal Data in data centers around the world, wherever Bitnuk facilities or service providers are located. As such, we may transfer your Personal Data outside of Switzerland and the European Union. Some of the countries to which your Personal Data may be transferred for these purposes that are located outside the EU do not benefit from an adequacy decision issued by the EU Commission regarding protection afforded to Personal Data in that country. Such transfers are undertaken in accordance with our legal and regulatory obligations and appropriate safeguards under DPL will be implemented, such as standard data protection clauses with data recipients or processors approved by competent authorities. YOUR STATUTORY RIGHTS
You have many rights concerning your Personal Data under DPL as mentioned below, and can exercise them by emailing us at [email protected].
Access: you are entitled to ask us if we are processing your information and, if we are, you can request access to your Personal Data. This enables you to receive a copy of the Personal Data we hold about you and certain other information about it to check that we are lawfully processing it. We process a large quantity of information, and can thus request, in accordance with the DPL, that before the information is delivered, you specify the information or processing activities to which your request relates.
Correction: you are entitled to request that any incomplete or inaccurate Personal Data we hold about you is corrected.
Erasure: you are entitled to ask us to delete or remove Personal Data in certain circumstances. There are also certain exceptions where we may refuse a request for erasure, for example, where the Personal Data is required for compliance with law or in connection with claims.
Restriction: you are entitled to ask us to suspend the processing of certain of your Personal Data about you, for example if you want us to establish its accuracy or the reason for processing it.
Transfer: you may request the transfer of certain of your Personal Data to another party.
Objection: where we are processing your Personal Data based on a legitimate interests (or those of a third party) you may challenge this. However we may be entitled to continue processing your information based on our legitimate interests or where this is relevant to legal claims. You also have the right to object where we are processing your Personal Data for direct marketing purposes.
Automated decisions: you may contest any automated decision made about you where this has a legal or similar significant effect and ask for it to be reconsidered.
You also have a right to lodge a complaint with a supervisory authority, in particular in the EU Member State where you reside, in Switzerland where we are based, or where an alleged infringement of Data Protection law has taken place. In Switzerland, you can make a complaint to The Federal Data Protection and Information Commissioner (FDPIC), which is the competent authority for data processing by federal bodies and private persons, including enterprises. As far as data processing by cantonal or communal authorities is concerned, the supervision is up to the cantonal and communal data protection commissioners. Please consider that, depending on the country from where you use the Bitnuk Services, not all the above rights may be available to you. Also, there might be cases where these rights cannot be enforced: for example, you cannot object to us using your information when it is required by the law, or to manage a complaint; similarly you cannot ask us to delete your information if you want to continue using the Bitnuk Services.
SECURITY OF PERSONAL DATA
We use a variety of security measures to ensure the confidentiality of your Personal Data, and to protect your Personal Data from loss, theft, unauthorised access, misuse, alteration or destruction. These security measures include, but are not limited to:
- Password protected directories and databases;
- Secure Sockets Layered (SSL) technology to ensure that your information is fully encrypted and sent across the Internet securely;
- PCI Scanning to actively protect our servers from hackers and other vulnerabilities.
All financially sensitive and/or credit information is transmitted via SSL technology and encrypted in our database. Only authorised Bitnuk personnel are permitted access to your Personal Data, and these personnel are required to treat the information as highly confidential. The security measures will be reviewed regularly in light of new and relevant legal and technical developments.
You are responsible for keeping your account passcode, membership numbers and pin numbers safe and secure. Do not share those with anyone. If there is an unauthorised use or any other breach of security involving your information, you must notify us below as soon as possible.
Please note, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal information, we cannot guarantee the security of your information transmitted to our site, unless you are communicating with us through a secure channel that we have provided. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorized access.
RETENTION OF PERSONAL DATA
We retain Personal Data for as long as necessary to fulfill purposes described in this Privacy Policy, subject to our own legal and regulatory obligations. The criteria we may use to determine the retention period for certain categories of data includes:
- How long you have been a Bitnuk member;
- whether there are contractual or legal obligations that exist that require us to retain the data for a certain period of time;
- whether there is any ongoing legal or financial claim that relates to your relationship with us;
- whether any applicable law, statute, or regulation allows for a specific retention period; and
- what the expectation for retention was at the time the data was provided to us.
While you use the Bitnuk Services, we will retain your personal information as long as necessary to provide you with the services of your choice. That would generally mean we retain your personal information as long as you are our customer and for a period of time afterwards. When our relationship with you ends, we still need to retain certain of your personal information for a time that depends on the legal and regulatory requirements of the country where you are located. For example, we will retain your information for the time allowed by the local laws to start a legal claim (so called “statute of limitation”), or for as long as we are ordered pursuant to on an order from the courts, or by law enforcement agencies or our regulators. In accordance with our record keeping obligations, we will retain Account and other Personal Data for at least five years (and some up to ten years, as required by applicable law) after an Account is closed.
UPDATES TO THIS PRIVACY POLICY
This Privacy Policy was last revised effective as of the notice at the beginning of this policy page. We may change this Privacy Policy from time to time, so it is advisable to review it frequently. Changes to this Privacy Policy will be announced on our website or through similar means for a reasonable length of time prior to and following the change taking effect.
Definitions
Account. The contractual arrangement wherein a Bitnuk member has accepted our Terms of Use and Privacy Policy, and received approval to use the Bitnuk Services, including the purchase and sale of Bitcoins and to perform associated Transactions;
Bitnuk Platform. Hardware and software technologies used by Bitnuk to provide the Bitnuk Service as set out in our Terms of Use;
DPL. means data protection law applicable to Bitnuk, including the Swiss Data Protection Act, draft of September 2017, its successors or implementing texts as well as equivalent legislation, which is applies to the processing of Personal Data by Bitnuk.
Personal Data. Information that identifies an individual, such as name, address, e-mail address, trading information, and banking details. Personal Data does not include anonymised and/or aggregated data that does not identify a specific user;
Service(s). The technological platform, functional rules and market managed by Bitnuk to permit Sellers and Buyers to perform purchase and sale transactions of Bitcoins and/or other Cryptocurrencies.
Transaction. Includes the following:

This document provides you with information about the risks associated with using trading in cryptocurrencies and with using the Bitnuk Service, which allows you to buy or sell interests in cryptocurrency via our partner cryptocurrency exchange(s) (each a “Cryptocurrency Exchange”).
The trading of goods and products, real or virtual, as well as virtual currencies involves significant risk. Prices can and do fluctuate on any given day. Due to such price fluctuations, you may increase or lose value in your assets at any given moment. Any currency - virtual or not - may be subject to large swings in value and may even become worthless. There is an inherent risk that losses will occur as a result of buying, selling or trading anything on a market. If you are in any doubt about whether the Cryptocurrency Service is right for you, you may wish to seek guidance from a professional adviser.
You should carefully assess whether your financial situation and tolerance for risk is suitable for any form of exposure to cryptocurrencies. You should never invest in cryptocurrencies unless you can afford to lose 100% of your investment.
Quantum Coins
Unlike most currencies that are backed by governments, other legal entities, or commodities such as gold or silver, Quantum Coins are a unique type of digital currency, backed by technology and trust. There is no central bank that can issue more currency or take corrective measures to protect the value of Quantum Coin in a crisis. Moreover, there is no guarantee that Bitnuk or any other cryptocurrency liquidity provider will purchase your Quantum Coins when you wish to sell them, or that they will maintain their value in relation to any fiat currency.
Trading in Cryptocurrencies is unregulated
Trading cryptocurrencies such as Bitcoin has special risks not generally shared with official currencies or goods or commodities in a market. Unlike most currencies, which are backed by governments or other legal entities, or by commodities such as gold or silver, cryptocurrencies are a unique kind of Internet digital currency, backed by technology and trust. There is no central bank that can take corrective measure to protect the value of any cryptocurrency in a crisis or issue more currency.
Instead, cryptocurrencies are an as-yet autonomous and largely unregulated global system of currency firms and individuals. Traders put their trust in a digital, decentralised, and partially anonymous system that relies on peer-to-peer networking and cryptography to maintain its integrity. As such, cryptocurrencies are not governed by any specific European or other regulatory framework. This means that, when you use the Bitnuk Service to purchase cryptocurrencies, you will not benefit from the protections available to customers receiving regulated e-money/payment services provided by us. Moreover, Bitnuk is not a bank and, as such, is not part of a depositor protection scheme. Bitnuk is also not subject to direct FINMA supervision.
We use our banking providers in order to receive client moneys and making payments. Our banking providers DO NOT transfer cryptocurrencies, exchange cryptocurrencies, or provide any services in connection with cryptocurrencies.
The value of Cryptocurrencies is highly volatile
The trading of cryptocurrencies is often susceptible to irrational bubbles or loss of confidence, which could collapse demand relative to supply. For example, confidence might collapse in cryptocurrencies because of unexpected changes imposed by software developers or others, a government crackdown, the creation of superior competing alternative currencies, or a deflationary or inflationary spiral. Confidence might also collapse because of technical problems: if the anonymity of the system is compromised, if money is lost or stolen, or if hackers or governments are able to prevent any transactions from settling.

Cryptocurrency exchanges are vulnerable to cyber attacks
- Cryptocurrency exchanges are entirely digital and, as with any virtual system, are at risk from hackers, malware and operational glitches. Even though Cryptocurrency Exchanges take various steps to preserve the security of their platforms, cryptocurrency which is held in wallets provided by such exchanges remain vulnerable to hacking.
- If a thief gains access to one or more Supported Cryptocurrencies (i.e. by stealing the private encryption key to the Cryptocurrency Exchange wallets), he/she could transfer the stolen assets to another account. This is particularly problematic since all cryptocurrency transactions are permanent and irreversible.
- Accordingly, a hack is likely to lead to substantial depletion of the Supported Cryptocurrency held on your behalf (see below). Whilst the Cryptocurrency Exchange may be willing to compensate users for any such loss, they are not obliged to do so. A serious hack could also have the effect of putting a Cryptocurrency Exchange into insolvency.
The supported cryptocurrencies (and the fiat currency used to buy/sell them) are held in custody by a third party.
- When you use the Bitnuk Service to buy interests in one or more of the Supported Cryptocurrencies, they will be held on your behalf by a third party (usually the Exchange) who will act as custodian (the “Custodian”). Records will be held by the Cryptocurrency Exchange and us to show that the Supported Cryptocurrencies are held on your behalf and do not belong to any third party.
- The Supported Cryptocurrencies may be held on an “omnibus basis” with the Custodian, which means that your interests may be held at a single blockchain address together with those of other customers of that Custodian. If the Custodian becomes insolvent, there may be delays in identifying the assets belonging to you. There may be also be an increased risk of loss if there should be a shortfall between the assets held in the Custodian’s omnibus account and the claims of all of its customers (in which case, you may have to share proportionately in that shortfall with other customers).
- Otherwise, in the event of insolvency of the Custodian, please note there is no specific legal protection that covers you for losses arising from any Supported Cryptocurrencies that were held with such Custodian. This could mean that you have no specific rights under insolvency law to recover cryptocurrency held by the Custodian and you may be treated as an ordinary creditor of the same.
- When you sell your interests in the Supported Cryptocurrencies, the proceeds from the sale will be held in a pooled segregated bank account of the Cryptocurrency Exchange. As with the Supported Cryptocurrencies, records will be held by the Cryptocurrency Exchange and us to show that funds are held on your behalf and do not belong to any third party. In the event of the Cryptocurrency Exchange’s insolvency, you may be able to claim for the return of your fiat currency from this pool.
The Cryptocurrency Exchange may terminate their service at any time
- To provide the Bitnuk Service to you, we partner with one or more Cryptocurrency Exchanges to (a) facilitate the buying and selling of interests in Supported Cryptocurrencies; and (b) in some cases, hold the Supported Cryptocurrencies as Custodian.
- Given the various risks attaching to cryptocurrency exchanges (including the uncertain legal environment), it is possible that a Cryptocurrency Exchange could suspend or terminate its relationship with us and may not tell us why. In these circumstances, we may have to suspend the Bitnuk Service ourselves but we will try to transfer the underlying Supported Cryptocurrency to another Cryptocurrency Exchange as soon as possible.
The legal status of cryptocurrency is uncertain and evolving
- Given that the market for cryptocurrencies is relatively new, the legal nature of cryptocurrency is, in most jurisdictions, yet to be determined by statute, regulation or case law. In the absence of such authority, it is not clear how a regulator or court may treat interests or rights arising cryptocurrency trading. In particular, the law applicable to firms who hold cryptocurrencies in custody (particularly in the event of such firms’ insolvency) is far from clear.
- It is possible that a national or supranational regulator may take unilateral action to legislate the cryptocurrency market in a manner which prevents or encumbers the proper operation of the market in your jurisdiction. This may impact whether we can offer the Cryptocurrency Service to you
The functioning of the cryptocurrency network is outside our control
- Since the Blockchain is an independent public peer-to peer network and is not subject to regulation or control by any governmental or other authority or firm, we are not responsible for any failure, mistake, error and/or breach which shall occur on the Blockchain or on any other networks in which the Supported Cryptocurrencies are being issued and/or traded.
- We do not own or control the underlying software protocols which govern the operation of the Supported Cryptocurrencies. In general, the underlying protocols are open source and anyone can use, copy, modify, and distribute them.
- The underlying protocols of the Supported Cryptocurrencies are subject to sudden changes in operating rules (‘forks’), and such forks may materially affect the value, function, and/or even the name of the Supported Cryptocurrency.

Money laundering is defined as the process where the identity of the proceeds of crime are so disguised that it gives the appearance of legitimate income. Criminals specifically target financial services firms through which they attempt to launder criminal proceeds without the firm's knowledge or suspicions.
In response to the scale and effect of money laundering, Switzerland has passed legislation designed to prevent money laundering and to combat terrorism. Anti-Money Laundering (AML) Policy:
The Bitnuk AML Policy is designed to prevent money laundering by meeting the Swiss AML legislation obligations including the need to have adequate systems and controls in place to mitigate the risk of the firm being used to facilitate financial crime. This AML Policy sets out the minimum standards which must be complied with and includes:
- The appointment of a Money Laundering Reporting Officer (MLRO) who has sufficient level of seniority and independence and who has responsibility for oversight of compliance with relevant legislation, regulations, rules and industry guidance;
- Establishing and maintaining a Risk Based Approach (RBA) towards assessing and managing the money laundering and terrorist financing risks to the company;
- Establishing and maintaining risk-based customer due diligence, identification, verification and know your customer (KYC) procedures, including enhanced due diligence for those customers presenting higher risk, such as Politically Exposed Persons (PEPs);
- Establishing and maintaining risk based systems and procedures to monitor on-going customer activity;
